More Light Urged on Court's 'Shadow Docket' – April 3, 2018

The Supreme Court issues its most important decisions after procedures visible to the public: legal briefs, now accessible online at the Supreme Court's website (www.supremecourt.gov); oral arguments with transcript and audio posted online by the end of the week; and written opinions, handed down in the courtroom and posted online all but simultaneously. But the Court also has what law professor William Baude has called a "shadow docket" with decisions or interim actions considered mostly out of sight and eventually announced with little fanfare. Court expert Kenneth Jost examines the Court's handling of these cases and the debate that Baude has helped to generate.
